  • Miss W came to GWCA solicitors in relation to an accident her daughter had suffered in Victoria Park, Worthing, West Sussex. A notice attached to a metal pole had rusted through causing the pole to break leaving only the base of the pole in the grass. The area and the pole were the responsibility of Worthing Borough Council who we felt had failed in their duty to inspect and maintain the area. Miss W's daughter tripped over the base of the broken pole and suffered a Torus fracture to her navicular bone in her foot.

    GWCA were instructed to deal with the claim on a No Win No Fee basis and an acceptance of liability was obtained from Worthing Borough Council. A report from a consultant orthopaedic surgeon was commissioned to confirm the extent of the injuries before a sum in compensation was agreed.

  • Mrs P was injured when a reversing car mounted the pavement and struck her back as she was sitting on a bench in Rustington, West Sussex. Mrs P was pushed off the bench by the impact and suffered an injury to her back. GWCA were instructed to deal with the claim on a No Win No Fee basis and an acceptance of liability was obtained from the driver. A report from a GP was commissioned to confirm the extent of the injuries. The driver's insurance company failed to make a reasonable offer and therefore the court was asked to make an award. The court agreed that the driver's insurance company's offer of compensation was too low and an award of damages in compensation was made.

The hospital failed to re x ray her wrist, as is normal standard practice, in order to ensure that the bones were properly aligned and healing correctly. As a result of the hospitals failure Mrs H suffered an increased level of pain and restricted movement.
